PRE-CONTRACTUAL INFORMATION FORM

1. SUBJECT

This Pre-Contractual Information Form has been prepared to inform the Buyer, who places an electronic order through the habbyaccessories.com.tr website operated by Habby Accessories, before the Distance Sales Agreement is concluded.

Before confirming the order, the Buyer acknowledges that they have read, understood, and electronically approved this Pre-Contractual Information Form.

4. PRODUCT AND SERVICE INFORMATION

The essential characteristics, sales price, total price including VAT, any shipping or delivery charges, and payment information relating to the product or products subject to the order are displayed to the Buyer on the Website before the order is confirmed.

Before placing an order, the Buyer is responsible for reviewing the product descriptions, product specifications, pricing information, delivery conditions, and any applicable conditions relating to custom production, custom dimensions, or custom cutting.

5. TOTAL PRICE AND PAYMENT INFORMATION

The sales price of the products including VAT, shipping charges, any additional service fees, and the total order amount are displayed to the Buyer during the payment process.

Payment is made using the payment methods offered on the Website. The Seller shall not be responsible for delays or technical issues arising from the payment method, payment institution, bank, or credit card processing systems.

6. DELIVERY INFORMATION

The products subject to the order are delivered to the address specified by the Buyer during the order process.

Delivery times may vary depending on product availability, the production process, the nature of the order, the operational procedures of the shipping company, and the delivery address.

Products that are in stock are handed over to the shipping company as soon as reasonably possible. Delivery times for custom production, custom dimensions, custom colors, custom cutting, samples, or wholesale orders may be determined separately.

For delivery to take place, the order price must have been paid and the delivery information must have been provided completely and accurately.

7. SHIPPING AND DELIVERY CHARGES

The shipping charge is displayed to the Buyer during the payment process. Free shipping may be offered as part of a campaign or for orders exceeding a specified value.

Free shipping applies only where the conditions stated during the order process are met.

8. RIGHT OF WITHDRAWAL

For distance sales transactions made in the capacity of a consumer, the Buyer may exercise the right of withdrawal within 14 days of receiving the product without providing any reason.

The withdrawal period begins on the date the product is delivered to the Buyer or to a third party designated by the Buyer.

The Buyer may also exercise the right of withdrawal before the product is delivered.

To exercise the right of withdrawal, the Seller must be notified in writing or through a durable medium within the 14-day period.

9. CIRCUMSTANCES IN WHICH THE RIGHT OF WITHDRAWAL MAY NOT APPLY

The right of withdrawal may not apply to the following products:

Products prepared specifically in accordance with the Buyer’s request or personal requirements
Products made in custom dimensions, custom colors, custom cuts, or through custom production
Wholesale products prepared specifically for a customer or company
Samples, custom-made products, or products prepared specifically for an order
Products that are unsuitable for return for hygiene reasons and whose packaging has been opened
Products that become mixed with other products after delivery and cannot be separated
Products that have been used, damaged, or have lost their resalable condition

Certain products offered for sale by Habby Accessories may be prepared in custom dimensions, custom colors, custom cuts, through custom production, or as part of a wholesale order according to the customer’s request. The right of withdrawal may not apply to products of this nature.

10. RETURN PROCESS

Where the right of withdrawal has been exercised in accordance with the applicable procedure, the Buyer must return the product to the Seller within 10 days of submitting the notice of withdrawal.

The returned product must be unused, undamaged, in resalable condition, and sent with its original packaging, accessories, and invoice, where applicable.

The Buyer is advised to contact the Seller before returning the product.

The Buyer may be responsible for additional charges and operational issues arising from shipments made through a carrier other than the Seller’s contracted shipping company.

11. REFUNDS

Where the right of withdrawal has been exercised in accordance with applicable legislation, the Seller shall refund the product price collected and, where applicable, the standard delivery costs within 14 days of receiving the notice of withdrawal.

The refund shall be made using the same payment method used by the Buyer. For refunds made to a credit card, debit card, or through another payment method, the time required for the amount to appear on the relevant card or account may vary depending on the processing times of the bank or payment institution.

If the product has been used, damaged, or has suffered a loss in value, the Seller may claim compensation for such loss from the Buyer or deduct the relevant amount from the refund in accordance with applicable legislation.

12. DEFECTIVE, DAMAGED, OR INCOMPLETE PRODUCTS

If the Buyer identifies a defect, damage, missing part, or incorrect product upon delivery, the Buyer must contact the Seller as soon as possible.

For deliveries involving damaged packages, a damage report should, where possible, be prepared in the presence of the shipping representative, and photographs of the product should be sent to the Seller.

The Buyer’s statutory rights regarding defective products remain reserved.

13. COMPLAINTS AND APPLICATION PROCEDURES

The Buyer may submit requests concerning orders, delivery, cancellation, returns, exchanges, or products to the Seller through the following communication channels:

For disputes arising from consumer transactions, Consumer Arbitration Committees and Consumer Courts shall have jurisdiction within the monetary limits and conditions specified by applicable legislation.

For purchases of a commercial nature, the provisions separately agreed between the parties and the general provisions of commercial law shall apply.

14. PROTECTION OF PERSONAL DATA

The Buyer’s personal data may be processed for purposes including receiving and processing the order, preparing the products, invoicing, delivery, customer service, return procedures, and compliance with legal obligations.

15. ELECTRONIC APPROVAL

Before confirming the order, the Buyer declares that they have read, understood, and electronically accepted this Pre-Contractual Information Form, the Distance Sales Agreement, and the Cancellation, Return and Right of Withdrawal Policy.

This Pre-Contractual Information Form is provided to the Buyer electronically and shall be deemed accepted when the Buyer confirms the order.

16. EFFECTIVE DATE

This Pre-Contractual Information Form applies to purchases made through the habbyaccessories.com.tr website.

Habby Accessories reserves the right to amend this Form, provided that any amendments comply with applicable legislation.
