CANCELLATION, RETURN AND RIGHT OF WITHDRAWAL POLICY

This Cancellation, Return and Right of Withdrawal Policy applies to purchases made through the habbyaccessories.com.tr website operated by Habby Accessories.

1. ORDER CANCELLATION

Orders may be cancelled before they are handed over to the shipping company or enter the production process.

You may submit your order cancellation request by email, telephone, or through the contact form. If the order has already been handed over to the shipping company, the return and right-of-withdrawal process shall apply instead of cancellation.

For custom-made products, custom dimensions, custom colors, custom cutting, or products prepared specifically for a customer or company, a cancellation request may not be accepted once production has begun.

2. RIGHT OF WITHDRAWAL

Under the distance sales agreement, the Consumer may exercise the right of withdrawal within 14 days of receiving the purchased product, without providing any reason.

The withdrawal period begins on the date the product is delivered to the Consumer or to a third party designated by the Consumer. The right of withdrawal may also be exercised before the product is delivered.

To exercise the right of withdrawal, the Consumer must notify us in writing or through a durable medium within the 14-day period.

4. RETURN OF PRODUCTS

After the notice of withdrawal has been received by us, the product must be returned within 10 days.

The returned product must be unused, undamaged, in resalable condition, and sent with its original packaging, accessories, and invoice, where applicable.

If the product has suffered a loss in value due to its use, compensation for such loss in value may be requested from the customer in accordance with applicable legislation.

6. REFUNDS

Where the right of withdrawal has been exercised in accordance with the applicable procedure, the product price collected and, where applicable, the standard delivery costs shall be refunded to the customer within 14 days of receiving the notice of withdrawal.

The refund shall be made using the same payment method used by the customer. For credit card or debit card refunds, the time required for the amount to appear on the relevant card or account may vary depending on the processing times of the bank or payment service provider.

7. CIRCUMSTANCES IN WHICH THE RIGHT OF WITHDRAWAL MAY NOT APPLY

The right of withdrawal may not apply to the following products:

Products prepared specifically in accordance with the customer’s request or personal requirements
Products made in custom dimensions, custom colors, custom cuts, or through custom production
Wholesale-order products prepared specifically for a customer or company
Products that are unsuitable for return for hygiene reasons and whose packaging has been opened
Products that become mixed with other products after delivery and cannot be separated
Products that have been used, damaged, or have lost their resalable condition

In particular, the right of withdrawal may not apply to custom production, custom dimensions, custom colors, custom cutting, samples, or wholesale products prepared specifically for a customer.

8. DEFECTIVE, DAMAGED, OR INCOMPLETE PRODUCTS

If the delivered product is damaged, incomplete, incorrect, or defective, the customer must contact us as soon as possible.

Where possible, a damage report should be prepared in the presence of the shipping representative for deliveries involving damaged packages, and photographs of the product should be sent to us.

The customer’s statutory rights regarding defective products remain reserved.

9. EXCHANGE REQUESTS

Product exchange requests shall be evaluated according to product availability, the nature of the product, and the conditions of the order.

Exchanges may not be available for custom production, custom dimensions, custom colors, custom cutting, or products prepared specifically for a customer.

To request an exchange, the customer must contact us after receiving the product.

10. WHOLESALE AND CUSTOM-PRODUCTION ORDERS

The cancellation, return, and exchange conditions applicable to wholesale sales, samples, custom production, custom dimensions, custom colors, custom cutting, or products prepared according to the customer’s instructions shall be evaluated separately according to the nature of the order.

For such products, cancellation, return, or the right of withdrawal may not be available once the production process has begun.

11. DISPUTE RESOLUTION

For disputes arising from consumer transactions, Consumer Arbitration Committees and Consumer Courts shall have jurisdiction within the monetary limits and conditions specified by applicable legislation.

For purchases of a commercial nature, any provisions separately agreed between the parties and the general provisions of commercial law shall apply.

12. EFFECTIVE DATE

This Policy applies to purchases made through the habbyaccessories.com.tr website.

Habby Accessories reserves the right to amend this Policy, provided that any amendments comply with applicable legislation.
